Bright Valley Marketing, LLC ("Bright Valley Marketing", "we", "us", "our") operates the website brightvalleymarketing.com. We respect your privacy. This policy explains what personal information we collect when you use our website, why we collect it, who we share it with, how long we keep it, and the rights you have. It is written for visitors in the United States, including California, and for visitors in the European Economic Area (EEA), the United Kingdom and Switzerland, whose data is protected by the GDPR and UK GDPR.
In short: our website has no user accounts, no comments and no online payments. The personal information we handle is what you send us through our forms, plus limited technical data. Analytics cookies are used only if you allow them, and we never sell your personal information.
1. Who we are
The website is operated by Bright Valley Marketing, LLC, 730 I Street, Suite 200, Sacramento, CA 95814, United States. For the purposes of the GDPR, Bright Valley Marketing, LLC is the controller of the personal data described in this policy.
Questions about this policy or your personal information: info@brightvalleymarketing.com or 916-607-9953.
2. Information we collect
Information you give us
- Contact form: your name, email address, company website, and the message you send us.
- Email and phone: anything you choose to tell us when you contact us directly.
Information collected automatically
Like most websites, our site and the services that run it receive technical information that browsers send with every request, such as your IP address, browser type, device type, language preference, the page that referred you, and the date and time of your visit. With your consent, analytics tools also record how you use the site (see section 6 and our Cookie Policy).
We do not knowingly collect sensitive information (such as health, financial or government ID data), and we ask you not to send it through our forms.
3. How we use your information, and our legal bases
- To reply to your enquiry and provide our services: we use the details you send to respond, to discuss your project and to prepare a proposal. Legal basis (GDPR): steps taken at your request before entering into a contract (Art. 6(1)(b)) and our legitimate interest in answering enquiries (Art. 6(1)(f)).
- To understand and improve our website: aggregated analytics, only with your consent (Art. 6(1)(a)), which you can withdraw at any time.
- To keep the website and its forms secure: detecting spam and abuse with ALTCHA. Legal basis: our legitimate interest in protecting the site (Art. 6(1)(f)).
- To comply with the law: for example, responding to lawful requests from public authorities (Art. 6(1)(c)).
We may publish aggregated, non-identifying statistics about how our website is used (for example, in a report on trends). These never identify you.
4. Who we share your information with
We do not sell or rent your personal information, and we do not share it for cross-context behavioral advertising. We share it only with:
- Our team and contractors who need it to respond to you or deliver our services, and who are bound to keep it confidential.
- Service providers that run our website and forms, each only to the extent needed for their service:
- Webflow: website hosting and form handling. (webflow.com/legal/privacy)
- ALTCHA: open-source spam protection that runs in your browser; it sets no cookies and does not track you.
- GitHub (GitHub Pages) and jsDelivr: deliver some of the website's script files; they receive your IP address to send the file and set no cookies. (GitHub privacy statement, jsDelivr privacy policy)
- Google (Tag Manager and Analytics): website analytics, only after you allow analytics. (policies.google.com/privacy)
- Microsoft Clarity: website analytics (how pages are used), only after you allow analytics. (privacy.microsoft.com)
- Ahrefs Web Analytics: website analytics, only after you allow analytics. (ahrefs.com/legal/privacy-policy)
- Google (YouTube): plays videos embedded on our pages in privacy-enhanced mode, which sets cookies only when you play a video. (policies.google.com/privacy)
- Authorities and others when required: if we must do so by law, subpoena or court order, or when we believe in good faith that disclosure is needed to protect our rights, your safety or the safety of others.
- A buyer or successor: if Bright Valley Marketing, or substantially all of its assets, is acquired, the information we hold may be transferred to the acquirer, who may continue to use it as described in this policy.
5. International transfers
We are based in the United States, and some of our service providers process data in the United States and other countries. If you are in the EEA, the UK or Switzerland, your information is transferred to the United States. Where a country does not have an adequacy decision, these transfers rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses or a provider's certification under the EU-U.S. Data Privacy Framework.
6. Cookies and analytics
Our website uses a small number of cookies. Strictly necessary cookies (for example, the one that remembers your cookie choice) are always on. Analytics cookies are set only if you allow them in our cookie banner. Before you choose, our analytics tools (Google Analytics, Microsoft Clarity and Ahrefs Web Analytics) do not run. Embedded YouTube videos use YouTube's privacy-enhanced mode, which sets cookies only when you play a video. You can change or withdraw your choice at any time through the "Cookie settings" link in the footer. The full list of cookies is in our Cookie Policy.
Do Not Track and Global Privacy Control: browsers can send "Do Not Track" or "Global Privacy Control" signals. Because analytics on our site run only after you opt in, nothing is tracked unless you choose to allow it, whether or not your browser sends these signals.
7. How long we keep your information
- Enquiries (contact form, email, phone): for as long as needed to respond and to follow up, and then for up to 24 months after our last contact, unless you become a client.
- Client records: for the length of our engagement and as long as needed afterwards for legal, tax and accounting purposes.
- Analytics data: kept by Google, Microsoft and Ahrefs in aggregated form for their standard retention periods.
- Your cookie choice: 6 months, after which we ask again.
8. Your rights
Everyone: you can ask us what personal information we hold about you, and ask us to correct or delete it.
EEA, UK and Switzerland: under the GDPR and UK GDPR you have the right to access, rectify and erase your personal data; to restrict or object to its processing; to data portability; and to withdraw consent at any time, without affecting processing done before you withdrew it. You also have the right to lodge a complaint with your local data protection authority (in the UK, the Information Commissioner's Office).
California: California residents have the right to know what personal information we collect and how we use and share it, to access and delete it, to correct it, and not to be discriminated against for exercising these rights. We do not sell or share personal information as those terms are defined under California law.
To exercise any right, email info@brightvalleymarketing.com. We may need to confirm your identity before acting on a request, and we will answer within the time the law requires (one month under the GDPR, 45 days under California law).
9. Security
We take reasonable technical and organizational measures to protect your information against loss, misuse and unauthorized access, alteration or destruction. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security.
10. Children
Our website is meant for businesses and is not directed at children under 16. We do not knowingly collect personal information from children. If you believe a child has sent us information, contact us and we will delete it.
11. Links to other websites
Our website links to other websites, such as our social media pages and articles we mention. Their own privacy policies apply when you visit them.
12. Changes to this policy
We may update this policy from time to time. The "Last updated" date at the top shows when it last changed. If a change is significant, we will make it clear on this page.
